Notice Of Impended Marriage (NOIM)

Under section 42 of the Marriage Act, Parties to an intended marriage are required to give the Celebrant notice of their marriage. This notice is known as the Notice of Intended Marriage and the form completed is also called the ‘Notice of Intended Marriage’ (NOIM).

The Notice of Intended Marriage (NOIM) is a legal document that must be completed and ‘received’ by the marriage celebrant at least one calendar month before the date of the wedding.

The couple must sign the NOIM in the presence of a qualified witness. A list of acceptable qualified witness is on the back of the NOIM.

If a party to an intended marriage cannot sign the NOIM at the time it is given to the celebrant, the NOIM can be ‘received’ with only one signature. However, the other party must sign the NOIM in the presence of that celebrant before the marriage is solemnised.

Documents That Must Be Sighted

Both parties to the marriage must produce documentation showing proof of their date and place of birth. The only forms of acceptable identification for this purpose are:

  • an original birth certificate (or extract), or

  • a passport.

The passport does not have to be current – an expired passport will still show their date and place of birth. However, a cancelled passport cannot be used.

Where a party has produced a birth certificate as proof of place and date of birth, photo ID must also be sighted.

If either party has changed their name, they must also produce official documentation to support the change of name.

In addition to documents showing their date and place of birth, a marrying couple who have been previously married must also produce documents relating to how that last marriage ended, such as:

  • divorce or nullity (also known as an annulment) papers, or

  • death certificate of the previous spouse.

All of these documents must be produced before the marriage takes place, however, they do not have to be sighted at the time of accepting the NOIM.

All documentation must be:

  • in English, or be accompanied by an official English translation (by an accredited translator), and

  • be the original document. Photocopies and certified copies are not acceptable.
